  1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your participation in fishing lessons (“Services”) offered through the website myFishingtrip.net, operated as a sole trader business (“School”, “we”, “us”, “our”).

By booking a lesson, making payment, or participating in any lesson (“Booking”), you (“Participant”, “you”, “your”) confirm that you have read, understood, and agree to be legally bound by these Terms on behalf of:

  • Yourself (if 18+ years); and/or
  • Any minor child/children under your care (if under 18 years) (“Minor”)

These Terms form a binding contract between you and the school. If booking for a Minor, you confirm you are the parent/legal guardian with authority to bind both yourself and the Minor to these Terms.

  1. SERVICES OFFERED

Our fishing school provides in-person/online, shore-based fishing lessons at public parks and beaches in the Dampier/Karratha area, Western Australia. Lessons include basic land-based fishing techniques suitable for beginners and all skill levels. All lessons include:

Lesson Types:

  • 1-on-1 Lessons: Maximum 1 student, 60 minutes duration
  • Group Lessons: Maximum 15 students, 150 minutes duration
  • Group Guided Lessons: Maximum 10 students, 60 minutes duration

Key Features:

  • Minimum age: 8 years & above
  • Open to locals and tourists
  • All fishing equipment provided, no personal gear needed/allowed.
  • Lessons conducted on public land only. There will be no boats, no water entry, no rocks.
  • Lesson times and locations vary by season based on weather, tides, fish availability.
  • Educational materials provided including PDFs, videos for personal use only.
  1. PHOTOGRAPHY, VIDEO AND LEARNING MATERIALS

By booking lessons for any Minor under 18, Parents/Guardians expressly consent to and authorize the school to photograph and/or video their Minor during lessons for marketing and promotional purposes. This includes use on the website, social media platforms, promotional materials, newsletters, and other advertising in perpetuity unless withdrawn in writing.

Parents/Guardians confirm and agree:

  • Images/videos may identify their Minor by location/activity context
  • Images may be edited, cropped, or used in combination with other content
  • No compensation will be provided for image usage
  • Consent may be withdrawn for future use only by emailing at [email protected] (previously published images removed within 30 days)

ADULT PARTICIPANTS (18+): By booking, you consent to similar photography/videography for marketing purposes (withdrawable by email).

PARTICIPANT RECORDING: Participants may take short personal videos/photos provided this does not interfere with instruction, safety, or other participants.

LEARNING MATERIALS: PDFs, videos, and resources provided remain the school’s intellectual property for personal educational use only. Participants and Parents/Guardians on behalf of minors must ensure that the learning materials are not copied, shared, published, sold, or used commercially without written permission.

Parents/Guardians booking for Minors confirm they have read, understand, and accept these photography requirements on behalf of their child.

  1. BOOKING & PAYMENT

All bookings must be made through the website booking system at www.myfishingtrip.net. Full payment is required in advance via credit card or Apple Pay before any lesson can be confirmed. All prices are displayed on the website, including any family or promotional pricing. Future packages and promotions will also be listed on the website. There are no late payment fees, and all prices includes taxes where applicable under Australian law. Once payment is processed, you will receive confirmation via email, and the price displayed at the time of booking will apply to that specific booking. Pricing is subject to change for future bookings.

  1. CANCELLATIONS

You may cancel your booking by emailing [email protected]. If you provide at least 2 days’ notice before the lesson start time, you will receive full credit to your account valid for 12 months to book another lesson. Cancellations with less than 2 days’ notice will not receive credit.

The school may cancel lessons due to approaching storms, heavy rain, winds over 17 knots, instructor unavailability, or other safety reasons. You will be notified by email or text message, the evening prior when reasonably possible. In such cases, you will receive full credit or the option to rebook the same lesson on any other available day. No cash refunds are provided – credit only. The school is not responsible for any travel, accommodation, or other costs you may incur due to cancellations.

  1. AGE & PARENTAL RESPONSIBILITY

The minimum age for participation is 8 years. All participants under 18 years (“Minors”) require written parental or legal guardian consent prior to booking. Parents and legal guardians (“Parents/Guardians”) booking on behalf of Minors confirm they have authority to bind both themselves and the Minor to these Terms.

Parents/Guardians are fully responsible for their Minor’s safety and supervision outside of direct lesson instruction periods. The school is not responsible for Minors during toilet breaks, when running, playing games, walking on the beach, or any other unsupervised activities. Parents/Guardians must assess whether their child is ready to participate without constant supervision.

Pick-up and drop-off will be recorded in a signed register. No ID checks will be conducted. Parents/Guardians confirm that only suitable adults will collect Minors from lessons. If a Minor leaves the group without permission or becomes unattended despite instructions, this remains the Parent/Guardian’s responsibility.

  1. HEALTH, FITNESS AND PARTICIPANT RESPONSIBILITIES

There are no specific health, fitness, or swimming requirements for participation, as all lessons are land-based and do not involve entering the water, boats, rocks, or open-water activities. By booking a lesson, you confirm that you (or the Minor you are booking for) are physically able to take part in outdoor activities for the duration of the lesson (60–150 minutes) and can follow instructions safely in a group setting.

Participants and, in the case of Minors, their Parents/Guardians are responsible for ensuring appropriate sun protection and hydration. Each participant must arrive with suitable sun-protective clothing, a hat, sunscreen already applied, drinking water, and any snacks they may need. The school does not provide sunscreen, hats, water, or food. Reminders to drink water, keep hats on, and take two short breaks during longer sessions will be given, but the school is not responsible for sunburn, dehydration, or heat-related illness where these requirements are not followed.

  1. SAFETY BRIEFING, RULES AND BEHAVIOUR

Each lesson begins with a safety briefing covering the use of fishing gear, group behaviour, sun safety and general conduct at the lesson location. By attending a lesson, you agree to listen to and follow all instructions given by the instructor at all times.

Participants must behave safely and respectfully towards the instructor and other students. Bullying, fighting, aggressive behaviour, refusing to follow safety directions, throwing or misusing equipment, or creating an unsafe environment may result in the participant being asked to sit out or removed from the lesson, with no entitlement to a refund or credit. Running, rough play and games may occur as part of the activities, but participants must stay within the designated area and remain with the group during instruction. If a child leaves the group, runs off or fails to follow safety instructions, this remains the responsibility of the Parent/Guardian.

  1. EQUIPMENT

All fishing equipment required for the lesson, including rods, reels, tackle and bait, is supplied by the school. Personal fishing gear is not required and is generally not permitted, as it may cause disruption or safety issues. Participants must use all equipment with care and only as directed by the instructor. If equipment is damaged or lost due to careless or improper use, the school may, at its discretion, ask the Participant or Parent/Guardian to contribute to reasonable repair or replacement costs on case-by-case basis.

  1. INSTRUCTOR QUALIFICATIONS AND EMERGENCY PROCEDURES

The school is operated by a sole trader with 25 years of recreational fishing experience and 9 years working in the fishing industry teaching children and beginners. The instructor holds a current Working with Children Check as required under Western Australian law for activities involving minors.

A first aid kit is available at all lessons. For minor injuries, first aid will be applied where appropriate and the lesson may continue if safe to do so. For serious injuries or where a participant wishes to leave early, parents/guardians will be notified immediately, and all incidents will be documented in writing with parent/guardian signature required. If a participant requires ambulance or medical attention, parents/guardians are responsible for any associated costs.

  1. WEATHER, LOCATION RISKS AND CANCELLATIONS

Lessons take place at public parks and beaches in the Dampier/Karratha area with no water access. The primary risks are sunburn and tripping hazards on sand or uneven surfaces. Participants accept these environmental risks by attending the lessons.

The school reserves the right to cancel lessons due to approaching storms, heavy rain, winds exceeding 17 knots, or other unsafe conditions. Where possible, notification will be sent by email or text the evening prior when reasonably possible. Cancellations for instructor unavailability follow the same credit/rebooking process outlined in Section 4.

  1. LIMITATION OF LIABILITY

Fishing lessons involve inherent risks including sunburn, dehydration, trips/falls on sand/uneven surfaces, minor cuts from fishing gear, and other injuries typical of outdoor recreational activities. Parents/Guardians booking for Minors (under 18) MUST acknowledge and accept ALL these risks on behalf of their child.

By booking and attending lessons, Parents/Guardians confirm:

  1. They have assessed their Minor is physically capable of participating safely for 60-150 minutes in outdoor conditions
  2. They accept FULL RESPONSIBILITY for their Minor’s safety outside direct instructor supervision (toilet breaks, running, beach play, etc.)
  3. They will ensure their Minor arrives with sun-protective clothing, hat, pre-applied sunscreen, water, and snacks
  4. Sunburn, heat illness, or dehydration resulting from inadequate preparation remains their responsibility

LEGAL RELEASE (Australian Consumer Law s139A): Parents/Guardians expressly release the school from all liability for death or personal injury to their Minor resulting from inherent risks of recreational fishing lessons.

To the maximum extent permitted by law, the school excludes liability for:

  • Any personal injury/death from inherent risks
  • Property damage to personal items
  • Economic loss (travel costs, lost time, etc.)
  • Injuries from failure to follow safety instructions
  • Injuries when Minors are unsupervised outside instructor control

Public Liability Insurance: The school holds public liability insurance of $10M. This covers School negligence only and does NOT cover Parent/Guardian failures in supervision, preparation, following instructions, or harm resulting out of the supervision of the school.

  1. PRIVACY AND GOVERNING LAW

By booking lessons for any Minor, Parents/Guardians expressly authorize the school to collect, store, and use their personal information AND their Minor’s personal information (names, ages, contact details, emergency contacts, medical information if provided, photos/videos) strictly for lesson delivery, safety management, communication, and marketing purposes as outlined in these Terms.

Parents/Guardians confirm and accept:

  • Collection is mandatory for booking and safety compliance
  • Information will NOT be sold or shared with third parties except as required by law
  • Access requests may be made to [email protected] (response within 30 days)
  • Information may be retained for 7 years after last lesson for legal/safety records
  • Parents/Guardians have right to correct inaccurate information by contacting the school

GOVERNING LAW: These Terms are governed exclusively by the laws of Western Australia.

  1. COMPLAINTS AND CONTACT INFORMATION

Any complaints, questions or concerns about lessons should be sent to [email protected]. The school owner will respond within 14 days. All complaints will be handled fairly and in good faith.

Welcome to the MyFishingTrip Platform, which consists of the myfishingtrip.net website and mobile applications (collectively known as the “Platform”). All sections of these Terms of Use and all references to the MyFishingTrip website also apply to MyFishingTrip mobile applications.

These Terms of use, (this “Agreement”) represent a legal agreement between you, an individual (“You”) and MyFishingTrip (collectively, “we” or “us”). (You and MyFishingTrip each a “Party” and collectively the “Parties”).

THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT MAY SIGNIFICANTLY IMPACT A USER’S RIGHTS CONCERNING HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

By using the Platform, you agree to be bound by the terms and conditions of this “Agreement”.

Please read this Agreement carefully prior to using the Platform. If you do not agree to be bound by this Agreement and to follow all applicable laws, you should leave the Platform immediately.

This Agreement will remain in full force and effect at all times, and may be modified from time to time.

Our Services

We take great pride in offering a diverse range of services designed to elevate your angling experience to new heights. At our core, we are committed to connecting passionate anglers, whom we refer to as ‘Travelling Anglers,’ with our network of seasoned fishing experts, known as ‘MFT Anglers’ or ‘Locals.’

Travelling Anglers have the privilege of choosing from three distinct packages, each thoughtfully designed to cater to anglers of varying experience levels and preferences. Whether you are a novice seeking foundational knowledge, an intermediate angler looking to refine your skills, or a seasoned pro aiming for advanced insights, our packages are tailored to meet your unique needs.

Upon selecting a package and making the corresponding payment in advance, Travelling Anglers will receive their chosen service promptly via email. For Packages 1 and 2, this entails receiving comprehensive PDF documents created in advance by our MFT Anglers. For Package 3, Travelling Anglers will receive booking information for a direct communication opportunity with an MFT Angler of their choice.

Our commitment to facilitating direct interaction between Travelling Anglers and MFT Anglers is a hallmark of our services. This real-time communication empowers you to engage with seasoned fishing experts through various channels, including messaging, phone calls, and video calls. These channels provide you with the opportunity to seek personalized advice, clarify doubts, and gain insights tailored to your specific angling requirements.

For phone and video calls, our website may provide convenient tools to arrange these interactions, ensuring a seamless experience. Alternatively, your phone number will be shared exclusively with the chosen MFT Angler to coordinate the call. It’s important to note that the contact details of our MFT Anglers will remain confidential and will not be disclosed to Travelling Anglers.

In cases where a scheduled call cannot be answered, we offer the option to reschedule it for a more suitable time. After the second unsuccessful attempt, we will consider the Travelling Angler eligible for a refund or, as an alternative, they may choose to receive the PDF from Package 2.

Notwithstanding MFT Anglers will be compensated for their call services only if the call is attended to in its entirety.

Our dedication to enhancing your angling experience knows no bounds. We are committed to ongoing improvement, constantly assessing and enhancing our services. This commitment includes exploring opportunities to expand our offerings, provide additional communication options, and elevate the overall user experience.

Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Services including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphic in the Services (collectively, the “Content”), as well all the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright, patent and trademarks laws (and various other intellectual property rights) and treaties in the Australia and around the world.

The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use or internal business purpose only.

Prohibited Uses

The Platform may be used only for lawful purposes and in accordance with this Agreement. Visitors to the platform and Users hereby agree not to use the Platform in any way that violates any applicable federal, state, local, or international law or regulation.

Users and Visitors further agree to use the Platform only for legitimate purposes. Users and Visitors agree to access the Platform only in accordance with these Terms of Use, as amended.

Indemnification

Each User, by making use of any of the Services of the Platform agrees to release, defend, indemnify, and hold MyFishingTrip and our affiliates and subsidiaries, and agents, harmless from any and all claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal fees arising out of or in any way connected with their use of any of the Platform. Notwithstanding any Australian or other law relating to the limitation of liability, Users agree to fully indemnify MyFishingTrip in the full amount of damages actually paid by MyFishingTrip pursuant to a dispute or controversy.

Users (the “Indemnifying Party”) will defend and indemnify MyFishingTrip (the “Indemnified Party”) against any and all claims, losses, costs, and expenses, including reasonable attorneys’ fees, that the Indemnified Party may incur as a result of claims in any form by third parties arising from:

  1. The Indemnifying Party’s intentional tortious or negligent acts or omissions (including, without limitation, non-compliance with any applicable legal and/or regulatory requirements);

  2. The Indemnifying Party’s breach of any representation, warranty, or covenant set forth herein;

Amendment

MyFishingTrip may review and update this Agreement from time to time at its sole discretion and timing. All revisions, updates, or changes are effective immediately when they are posted to the Platform and apply to all access to and use of the Platform and MyFishingTrip Services thereafter. Users are expected to check, read, and agree to this page each time they access or utilize MyFishingTrip Services so they are aware of any revision, update, or change, as they are binding on them immediately.

Force Majeure

MyFishingTrip will not be liable or responsible, nor be deemed to have defaulted or breached this Agreement for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, electronic outages, website, app or Internet malfunctions, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lock-outs, lockdowns, strikes or other labor disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown, or power outage.

Binding, Entire Agreement

This Agreement will be binding upon and inure to the benefit of the parties hereto. This Agreement sets forth the entire agreement and understanding between the parties as to the subject matter thereof and merges and supersedes all prior discussions, agreements, and understandings of any and every nature between them.

Notice

All notices and communications under these Terms and Conditions shall be in writing and sent to the email address. Notices to Users will be sent to the email address associated with their account, and notices to MyFishingTrip shall be sent to [email protected]. Both Users and MyFishingTrip agree that electronic communication constitutes valid and effective notice.

Governing Law, Venue

This Agreement and its validity, construction, and performance will be governed in all respects by the law of the Australia, notwithstanding its or any other jurisdiction’s choice of law principles without regard to its conflict of laws provisions. Any dispute or controversy arising out of, relating to, or in connection with this Agreement will be exclusively resolved in Australia, through binding arbitration (see Arbitration).

Waiver, Severability

The waiver by MyFishingTrip of a breach of any provision of this Agreement will not operate or be construed as a waiver of any subsequent breach. If any term or provision of this Agreement or the application thereof to any person or circumstance will, to the extent applicable, be invalid or unenforceable, the remainder of this Agreement and the application of such term of provision to persons or circumstances other than those as to which it is held invalid or unenforceable, will not be affected thereby and each term and provision of this Agreement will be valid and be enforced to the fullest extent permitted by law.

Class Action Waiver

Both you and MyFishingTrip agree that each may bring claims against the other in an individual capacity only. Neither you nor MyFishingTrip may bring a claim as a plaintiff or class member in any class action, consolidated action, or representative action.

Arbitration

Any dispute or claim relating in any way to your use of any of MyFishingTrip’s Services will be resolved by binding arbitration in accordance with the rules for commercial arbitration of the Australian Centre for International Commercial Arbitration (ACICA) (or a similar organization) in effect at the time such arbitration is initiated, and subject further to the provisions of the International Arbitration Act 1974. The decision of the arbitrator will be final and binding upon all Parties. In the event that your claim is rejected, you are obliged to reimburse all costs, including but not limited to arbitration fees and any other legal fees, incurred in the proceeds.

No Third Party Beneficiaries

Nothing contained herein is intended, nor will it be construed, to confer any rights or benefits upon any person (including, but not limited to, any employee, agent, contractor, officer, shareholder, member, manager or former agent of you) other than you, and no other person will have any rights or remedies under this Agreement.

Security

MyFishingTrip is very concerned with safeguarding Users’ information. When Users enter sensitive information on MyFishingTrip forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. If Users have any questions about the security of our Services, they can contact us via [email protected].

MyFishingTrip will make any legally required disclosures of any breach of the security, confidentiality, or integrity of our unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to Users via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, insofar as consistent with:

  1. The legitimate needs of law enforcement; or

  2. Any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
